Who Are Guildford Tree Surgeons?

  • “Guildford Tree Surgeons” – Is a trading name of Foremans Tree Specialists Ltd.

Definitions

  • “We” / “Us” / “Our” / “Contractor” / “Contractors” / “Foremans Tree Specialists Ltd” / “Guildford Tree Surgeons” – The individual or business/company who is undertaking/carrying out the work.
  • “You” / “They” / “Client” / “Clients” – The individual or the business/company who is instructing/commissioning the work.
  • “Quote” / “Quotation” – A written description of the work required, associated costs which must include the client’s details and site address.
  • “Estimate”/ “Estimations” – A written description of the work required, an estimated cost (subject to change) which must include the client’s details and site address.
  • “Contract” – The agreement between the contractor and the client for the work specified on the quotation.
  • “Work/s” – Tasks instructed by the client and carried out by the contractor. Arboricultural related works will comply with 3998 British Standard Guidelines For Tree Work.

Quotations And Estimates

  • All quotes and estimates are only valid for 30 days. 
  • We provide all quotations and estimates without obligation.
  • For jobs with a value of £500 plus VAT or more, we request a 10% deposit upon acceptance of all quotations and estimates. *We will be unable to commence any work until the 10% deposit is received in full.
  • For the supply of any trees, hedging, shrubs and plants we require 100% payment upfront.
  • We charge VAT at the current rate and specify this on all quotes, estimates and invoices.

The Agreement

  • Acceptance of quotations and estimates, verbally or in writing, enters the client and contactor into a legally binding contract. The client is legally obliged to pay the contractor upon completing the work specified in the accepted quotation/estimate.
  • It is the clients’ responsibility to read the terms and conditions outlined below. By accepting the quote/estimate, you agree to the terms and conditions specified on this page.
  • Unless instructed otherwise, the contractor commits to completing all arboreal tasks in keeping with the current British Standard 3998 tree work recommendations. 
  • The contractor will leave the worksite safe and suitably clean/tidy, relative to the sites’ original condition. Due to our work’s nature, a small amount of mess and minor damage are inevitable and unavoidable.
  • If the contractor is working over multiple days, the site will be left safe, clean and tidy at the end of each day. 

Cancellations and Alterations

  • If the client wishes to postpone or cancel the work, you must inform the contractor as soon as possible. If you give us less than 24 hours notice, we reserve the right to charge for 50% of the agreed quotation. That said we are very understanding, and the 50% charge is at our discretion. 
  • If the client wishes to cancel the contract after the work has begun, we reserve the right to charge for 75% of the remaining work’s value.
  • The client accepts a quotation, but then wishes to make changes or requires additional work, they must inform the contractor as soon as possible. Changed job specifications and extra work should be itemised by a revised or additional written quotation.  
  • The contractor’s obligation ends when the client has confirmed they are satisfied with the works. If you are not happy with the result, you must notify the contractor as soon as possible. 
  • If an unforeseen event prevents the contractor from completing the agreed work, the client can decide to postpone or annul the contract.
  • The contractor reserves the right to postpone or cancel any work due to adverse weather or changes to the site/tree condition that would make the job too hazardous to proceed.
  • If the contractor has provided a quotation based on photos the client has taken, we reserve the right to annul the agreement if the photographs are misleading or misrepresentative.

Liability

  • It is the client’s responsibility to inform neighbours and third parties of the proposed works. Communication with neighbours is crucial if trees overhang the client’s boundary as we may need access to their property to carry out the job effectively. We suggest informing any third parties and neighbours well in advance to avoid delays or opposition on the day scheduled to complete the work. 
  • The clients’ responsibility is to make arrangements with their neighbours, tenants or third parties to allow the contractor access. If a neighbour, tenant or third party is not available to provide us access at the time and date agreed, we reserve the right to charge the client up to 50% of the proposed work value.
  • The contractor is not responsible for damage to any underground utilities or services such as water pipes or cables unless the client identifies/highlights them at the quotation stage.
  • Should damage to property or identified/highlighted underground services occur due to negligence or poor working practices, the contractor will accept liability.
  • The contractor is responsible for checking if the tree/s are subject to a TPO (Tree Preservation Order) and if the work is taking place within a conservation area. If you commit to using Foremans Tree Specialists Ltd to carry out the work, we can apply for, and obtain all the relevant council permissions free of charge. However, should we submit an application and you then cancel the contract, we reserve the right to charge a £50+VAT admin fee. We also offer application as a standalone service; please contact us for details. 
  • If the client has obtained permission for work, they are responsible for providing copies to the contractor before any work occurs.
  • If free or “pay and display” parking is not within a suitable distance from the worksite, the client is responsible for providing parking permits to accommodate vehicles/machinery. It is not the contractors’ responsibility to obtain any parking permits in controlled parking zones; inability to park may prevent us from completing the work.
  • The clients are responsible for paying any parking fines where they fail to provide a valid parking permit, and no alternative parking is available.
  • If we are severely delayed or unable to carry out the agreed work due to lack of suitable parking, we reserve the right to charge up to 50% of the proposed work value.
  • The contractor is not liable for any property damage resulting from working in poor/adverse weather conditions.
  • The client is responsible for clearing their property, ornaments, garden furniture, potted plants etc. from the proposed working area to allow the contractor access to complete the agreed work. Obstacles will slow or processes down, and they risk getting damaged. If you require help moving your property/obstacles, you must make us aware at the quotation stage.
  • The client must ensure the working area and access to it is free from any pet, animal or other excrements/waste matter. It is not the contractors’ responsibility to create a hygienic working environment. We reserve the right to cancel the work or postpone it until the worksite is excrement free and suitably clean enough to operate. We reserve the right to charge up to 50% of the agreed work value if we need to cancel the job due to unhygienic working conditions. Should the contractors, their clothing or equipment come into contact with unhygienic substances, we may charge a cleaning fee of up to £50+VAT
  • The client must inform the contractor of changes to the worksite, from the time of quotation, that could slow down, affect, prevent the planned work. We reserve the right to amend or annul the contract as a consequence of changes to the worksite.
  • The contractor has the right to subcontract part or all of the work commissioned, but the client will remain subject to these terms and conditions.

Stump grinding specific

  • The contractor is not responsible for damage to any underground utilities or services such as water pipes or cables unless the client identifies/highlights them at the quotation stage.
  • Should damage to property or identified/highlighted underground utilities/services occur due to negligence or poor working practices, the contractor will accept liability for the damage caused.
  • It is the clients’ responsibility to keep pets and children away from the stump grinder/worksite. We suggest keeping pets and children inside as they can be very unpredictable and may come to harm if left unattended.
  • We grind stumps to a depth of 250mm below the ground level immediately adjacent to the stump as standard. 
  • We grind the buttress (main body of the stump) but not the lateral roots (extending away from the body). 
  • All arisings (debris/grindings) resulting from stump grinding will be left on-site unless agreed otherwise. We use the grindings to backfill the voids as we cannot leave open holes for health and safety reasons.
  • We can grind deeper than 250mm, include lateral roots and remove grindings, but we must agree to this at the quotation stage, and the processes may incur additional costs.

Payment

  • Full payment is due 15 days from the date the invoice is issued. We reserve the right to charge 10% per week on fees outstanding more than 30 days. 
  • We accept payment via BACS (Bank Transfer), Cheque or Cash.
